The National Insurance Crime Bureau (NICB) states that approximately $7.2 billion a year accounts for workers’ compensation fraudulent claims.  The NICB characterizes workers’ compensation fraud as the “fastest growing segment of insurance fraud” in the nation. If it were a legitimate business it would rank among Fortune 500 companies. Insurance fraud costs everyone.

Claimant fraud is the most prevalent type of fraud. It is also the type that employers are in the best position to help avoid or uncover. Claimant fraud occurs when employees knowingly lie to collect benefits.

Statistics show that 60% of resumes have been falsified and with this in mind we encourage our clients to allow us to take steps to find out about their employees. We do not want our clients to discriminate but to find out about who they are hiring, and then work towards placing them in the right position. Often times the employee does not report all past employers because of some reason or another and this can be seen as falsifying information. Section 110 of Title 85-Oklahoma Statutes states “Except as otherwise provided by state or federal law and subject to the provisions of this section, an employer may inquire about previous workers’ compensation claims paid to an employee while the employee was employed by a previous employer. If the employee fails to answer truthfully about any previous permanent partial disability awards made pursuant to workers’ compensation claims, the employee shall be subject to discharge by the employer.”
